winmaya Terms & Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player," "User," or "you") and winmaya ("winmaya," "we," "us," or "our"), the operator of the online gaming platform accessible at winmaya.lat (the "Platform"). These Terms govern your access to and use of the Platform, including all games, services, features, promotions, and content offered therein.

By accessing the Platform, registering an account, or placing any wager on winmaya, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, together with the winmaya Privacy Policy and any specific terms applicable to individual promotions or game types. If you do not agree with any part of these Terms, you must immediately cease use of the Platform and, if applicable, close your account.

winmaya operates in alignment with the guidelines and policies issued by the Philippine Amusement and Gaming Corporation (PAGCOR), which governs online gaming activities in the Philippines. These Terms are designed to reflect those regulatory requirements as well as internationally accepted responsible gaming standards.

Access to winmaya and participation in any real-money gaming activity on the Platform is subject to the following eligibility requirements, all of which must be satisfied continuously throughout your use of the Platform:

1. Age: You must be at least 21 years of age at the time of registration and at all times during your use of winmaya. This requirement reflects the minimum age mandated by PAGCOR for online gaming in the Philippines. winmaya enforces this requirement through Know Your Customer (KYC) identity verification using a valid Philippine government-issued identification document.
2. Legal Capacity: You must have the full legal capacity to enter into a binding agreement under the laws of the Republic of the Philippines. Persons under legal guardianship or otherwise deemed legally incapacitated are not permitted to register or play.
3. Jurisdiction: You must be physically located in a jurisdiction where online gambling is not prohibited by applicable law at the time you access the Platform. It is your sole responsibility to ensure that your use of winmaya complies with the laws of your jurisdiction.
4. Not Self-Excluded: You must not be subject to a current self-exclusion order or mandatory exclusion from gambling, whether imposed by you voluntarily through winmaya's tools, or by any regulatory authority.
5. No Prior Permanent Suspension: You must not have had a winmaya account permanently suspended for violations of these Terms.

To access real-money features of the winmaya Platform, you must register an account. The registration process requires you to provide accurate, complete, and current information, including but not limited to your full legal name, date of birth, Philippine residential address, email address, and mobile number linked to your chosen payment method (e.g., GCash or PayMaya).

One Account Policy: Each individual is permitted to register and maintain only one (1) winmaya account. Operating multiple accounts — whether under the same or different identities — is strictly prohibited. winmaya employs technical and manual detection methods to identify duplicate accounts. Where duplicates are identified, all associated accounts may be suspended and all balances therein forfeited.

Account Security: You are solely responsible for maintaining the confidentiality of your login credentials, including your username, password, and any two-factor authentication codes. winmaya will never ask for your password through any communication channel, including live chat, email, or SMS. You must notify winmaya immediately at [email protected] if you suspect unauthorized access to your account.

KYC Verification: winmaya reserves the right to request identity verification documents at any stage of your account lifecycle, including at registration, upon a withdrawal request, or if suspicious activity is detected. Accepted documents include Philippine government-issued IDs such as a Passport, Driver's License, PhilSys National ID, SSS ID, UMID, PRC ID, or Voter's ID. Failure to provide satisfactory verification documents within the stipulated timeframe may result in account restrictions and suspension of withdrawals.

You agree that all information provided to winmaya during registration and at any subsequent point is truthful and accurate. Providing false or misleading information constitutes a material breach of these Terms and may result in immediate account termination and forfeiture of funds.

winmaya accepts deposits via the following Philippine payment channels: GCash, PayMaya, BPI Online Transfer, BDO Online Transfer, Metrobank Online, InstaPay, PESONet, and Visa/Mastercard debit and credit cards. All transactions on the Platform are denominated in Philippine Pesos (PHP / ₱).

The minimum deposit amount at winmaya is ₱100. Maximum deposit limits vary by payment method and may be further subject to your account verification status. Deposits made via GCash and PayMaya are credited to your winmaya account balance instantly upon successful processing by the respective payment provider.

winmaya does not accept deposits from third-party accounts. The name on the payment method used for deposits must match the name on your registered winmaya account. Any deposit made from a payment method not held in your name may be reversed and the corresponding funds held pending investigation.

winmaya does not charge fees for deposits; however, your bank or payment provider may impose their own transaction charges. winmaya is not responsible for any fees charged by third-party payment processors.

Withdrawal requests at winmaya are processed subject to the following conditions:

• Your account must have completed KYC identity verification to the satisfaction of winmaya's compliance team.
• Withdrawals must be made to a payment method registered in your own name and matching the details on your winmaya account.
• The minimum withdrawal amount is ₱200. Maximum withdrawal amounts per transaction and per day are subject to limits that may vary based on your account tier and payment method.
• Withdrawal requests are typically processed within one (1) to twenty-four (24) hours. GCash and PayMaya withdrawals are generally processed fastest, often within the hour during business hours.
• winmaya reserves the right to conduct additional verification before processing any withdrawal. During such review, the withdrawal will be placed in a pending state and you will be notified accordingly.
• If a bonus has been credited to your account, any associated wagering requirements must be fully met before the bonus-derived funds (and in some cases the entire account balance) become eligible for withdrawal, as detailed in Section 6.

winmaya reserves the right to delay or decline a withdrawal request in cases where: (a) the account has not completed required KYC verification; (b) winmaya suspects fraudulent activity, money laundering, or a breach of these Terms; (c) a chargeback or payment dispute is pending on the account; or (d) the withdrawal amount is derived from a bonus whose wagering requirements have not been satisfied.

winmaya may offer promotional bonuses, free spins, cashback offers, reload bonuses, tournament prizes, and other incentives ("Promotions") to eligible players from time to time. All Promotions are subject to these general bonus terms as well as any specific terms and conditions published alongside each individual Promotion.

Wagering Requirements: Unless explicitly stated otherwise in the specific promotion terms, all bonus funds credited to your winmaya account are subject to a wagering requirement. The wagering requirement specifies the total amount you must wager using the bonus funds (or, in some cases, the sum of the deposit plus the bonus) before the bonus or any winnings derived from it become eligible for withdrawal. Specific wagering multipliers and eligible games are detailed in each Promotion's terms.

Bonus Expiry: All bonuses and free spins issued by winmaya carry an expiry period, stated in the relevant Promotion's terms. Any unused bonus funds or free spins that expire before the wagering requirements are met will be forfeited without compensation.

Abuse and Fraud: winmaya reserves the right to void any bonus, cancel any winnings derived from a bonus, and suspend or close any account where winmaya determines, in its reasonable judgment, that a bonus has been claimed, used, or exploited in a manner inconsistent with the spirit of the Promotion, including but not limited to: claiming multiple bonuses through duplicate accounts; using low-risk or low-variance betting strategies specifically designed to meet wagering requirements while minimizing genuine risk; or providing false information to qualify for a Promotion.

winmaya reserves the right to modify, suspend, or withdraw any Promotion at any time and without prior notice, subject to any rights already accrued by players prior to such modification.

All games available on the winmaya Platform are supplied by licensed third-party game providers including, without limitation, Evolution Gaming, Pragmatic Play, PG Soft, Jili, and Ezugi. Each game operates according to its own specific rules, which are accessible within the game interface. winmaya strongly recommends that all players familiarise themselves with the rules and paytables of any game before wagering.

Random Number Generators: All slot games and non-live casino games offered on winmaya use certified Random Number Generator (RNG) technology. RNG systems are independently tested and certified to ensure genuinely random and fair outcomes. The published Return-to-Player (RTP) percentages for each game represent theoretical long-term averages and do not guarantee any specific outcome during an individual session.

Live Dealer Games: Live casino games on winmaya are conducted by professional dealers in certified studios and streamed to players in real time. The results of live games are determined by physical outcomes (cards dealt, dice rolled, roulette wheel spun) and are not subject to software RNG. All live game sessions are recorded and retained for dispute resolution purposes.

Malfunctions: In the event of a technical malfunction or communication error during a game, winmaya's technical team will investigate the incident. Where a malfunction has affected the outcome of a game, winmaya reserves the right to void the affected game round and refund the relevant wager to the player's account balance. winmaya's decision in such matters is final.

winmaya does not permit the use of automated betting software, bots, artificial intelligence tools, or any other form of automation to place wagers on the Platform. Any such activity constitutes a serious breach of these Terms and will result in immediate account suspension and forfeiture of funds.

The following conduct is strictly prohibited on the winmaya Platform. Violation of any of the following may result in immediate account suspension, permanent closure, forfeiture of all balances, and referral to relevant law enforcement or regulatory authorities:

• Registering or using a winmaya account if you are under 21 years of age.
• Registering more than one winmaya account.
• Providing false, inaccurate, or misleading information during registration or KYC verification.
• Using another person's payment method, account, or funds to make deposits on the Platform.
• Engaging in any form of money laundering, including using the Platform to obscure the source of illicit funds.
• Using automated software, bots, scripts, or artificial intelligence tools to interact with games or the Platform.
• Colluding with other players to gain an unfair advantage in multiplayer games or tournaments.
• Exploiting software bugs, errors, or glitches to obtain funds or winnings not legitimately earned.
• Attempting to reverse-engineer, decompile, or access the source code of any game or Platform component.
• Initiating fraudulent chargebacks or payment disputes after receiving winnings or bonuses.
• Threatening, harassing, or abusing winmaya staff or other players through any communication channel.

winmaya is committed to promoting responsible gaming across its entire Platform. Gaming is intended to be an enjoyable leisure activity, and winmaya recognizes its responsibility to minimize the potential for harm to players and those around them.

Responsible Gaming Tools: All winmaya players have access to the following tools through the Account Settings section of their dashboard:

• Deposit Limits: Set daily, weekly, or monthly caps on the total amount you can deposit. These limits take effect immediately when reduced and after a cooling-off period when increased.
• Loss Limits: Cap the maximum amount you can lose within a defined period. Once your limit is reached, no further real-money gameplay is permitted until the period resets.
• Session Time Reminders: Configure alerts that notify you of how long you have been actively playing in a single session.
• Reality Checks: Enable periodic on-screen messages showing your session duration and net gaming balance to support informed decision-making.
• Self-Exclusion: Voluntarily restrict your access to the winmaya Platform for a defined period ranging from 24 hours to permanent exclusion. During a self-exclusion period, logins, deposits, and gameplay are blocked.

winmaya requires all players to comply with the 21+ age requirement. Players who believe they or someone they know may have a gambling problem are encouraged to contact the winmaya support team, which can connect them with professional counselling resources and the National Problem Gambling Helpline.

winmaya reserves the right to suspend, restrict, or permanently close any player account at its sole discretion, with or without prior notice, in any of the following circumstances:

• Breach of any provision of these Terms.
• Failure to complete KYC verification within a stipulated timeframe.
• Evidence or reasonable suspicion of fraud, identity theft, money laundering, or other illegal activity.
• A player being found to be under 21 years of age.
• Use of automated tools or software in contravention of Section 7.
• A chargeback being initiated on a deposit transaction.
• winmaya being required to do so by regulatory directive or court order.

Where an account is suspended pending investigation, the account balance will be preserved and will not be forfeited unless the investigation concludes that the player has engaged in conduct warranting permanent closure and forfeiture under these Terms. winmaya will communicate the outcome of any investigation to the affected player via their registered email address.

Players may also voluntarily close their winmaya account at any time by contacting [email protected]. Prior to closure, any outstanding wagering requirements attached to bonus funds must be reviewed; bonus-derived balances that have not met their requirements will be forfeited upon account closure, while genuine cash deposits with no associated wagering conditions remain withdrawable.

All content on the winmaya Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, software, and the compilation thereof ("Content"), is the property of winmaya or its content suppliers and is protected by Philippine and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your own personal, non-commercial entertainment purposes. This licence does not include any right to: reproduce, distribute, publicly display, or create derivative works from any Content; systematically download or cache any Content; use data mining, robots, or similar data gathering tools; or frame or mirror any Content on any other website or application.

The winmaya name, logo, and all related product and service names, designs, and slogans are trademarks of winmaya or its licensors. You may not use these marks without the prior written permission of winmaya.

To the fullest extent permitted by applicable law, winmaya and its directors, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Platform, including but not limited to: loss of profits or revenue; loss of data; loss of goodwill; business interruption; or the cost of substitute services.

winmaya's total aggregate liability to any player in respect of any claim arising from or relating to the Platform or these Terms shall not exceed the amount deposited by that player in the thirty (30) days immediately preceding the event giving rise to the claim.

winmaya does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. The Platform is provided on an "as is" and "as available" basis, and winmaya expressly disclaims all warranties, whether express, implied, statutory, or otherwise, to the fullest extent permitted by law.

Nothing in these Terms shall limit or exclude winmaya's liability for: (a) death or personal injury caused by winmaya's gross negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable Philippine law.

winmaya collects, processes, and stores your personal data in accordance with its Privacy Policy, available at winmaya.lat/privacy-policy. By registering an account with winmaya, you acknowledge that you have read the Privacy Policy and consent to the processing of your personal data as described therein.

winmaya is committed to protecting your personal information and complies with the Data Privacy Act of 2012 (Republic Act No. 10173) of the Philippines and other applicable data protection laws. Your personal data will not be sold to third parties and will only be shared with winmaya's operational partners where necessary to provide the services described on the Platform.

winmaya reserves the right to revise, amend, or supplement these Terms at any time. When material changes are made, winmaya will provide reasonable notice to registered players via email to the registered address on the account, a notification displayed on the Platform upon login, or both.

Amendments take effect on the date specified in the notification. Your continued access to or use of the winmaya Platform following the effective date of any amendment constitutes your binding acceptance of the revised Terms. If you do not agree with the amended Terms, you must cease using the Platform and may request account closure in accordance with Section 10.

It is your responsibility to review these Terms periodically. The "Effective Date" at the top of this document will reflect when the Terms were last updated.

These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Internal Complaints: If you have a complaint regarding any aspect of your experience with winmaya, we encourage you to contact our customer support team first at [email protected]. winmaya aims to acknowledge all complaints within 24 hours and resolve them within five (5) business days. More complex matters may require additional time, and you will be kept informed of progress.

Formal Disputes: If a complaint cannot be resolved through winmaya's internal process to your reasonable satisfaction, any formal legal dispute shall be subject to the exclusive jurisdiction of the competent courts of the Republic of the Philippines.
